What is Powers of Attorney in the UK?

A Power of Attorney is a legal document that allows you to appoint one or more trusted people, known as attorneys, to make decisions on your behalf if you lose mental capacity or no longer wish to make certain decisions yourself.

In England, the main form used today is a Lasting Power of Attorney (LPA), governed by the Mental Capacity Act 2005. There are two types:

Property and Financial Affairs LPA
Health and Welfare LPA

An LPA must be registered with the Office of the Public Guardian before it can be used. The Mental Capacity Act 2005 sets out the legal framework, including the requirement that the person making the LPA must have mental capacity at the time of signing. If no valid LPA is in place and capacity is lost, family members may need to apply to the Court of Protection for a Deputyship Order, which is typically more costly and time-consuming.

Do I Need a Solicitor to Set Up Powers of Attorney?

It is not a legal requirement to use a solicitor to create a Lasting Power of Attorney.

However, mistakes in wording, incorrect signing or failing to follow strict procedural rules can result in rejection by the Office of the Public Guardian. This can cause significant delays and additional fees. More importantly, poorly drafted instructions may create uncertainty or disputes later.
