At ASL we aim to always be transparent and open about our fees. To best assess your case and provide a realistic price quotation, we normally offer a free consultation with one of our solicitors or fee earners over the phone.

In most of these initial consultations, we will provide an estimate of the costs involved in your case and you can decide whether you wish to continue with us. However, we may need to request further information before advising you of potential costs. We understand that everyone has different requirements, which is why we provide a variety of flexible funding options.

 Fixed Fee:

We predominantly operate on a fixed fee basis. We offer a fast and professional service from start to finish and this includes advising you of all the costs right at the start of your matter.

The fixed fee only changes if there are substantial changes in your circumstances which require significant extra work, and we will always notify you beforehand. Otherwise, the fixed fee is all that you must pay.

Third Party Funding Arrangements – This is where your case would be funded by another party in exchange for an agreed share of sums recovered. Please note this is in limited circumstances only.

Immigration Fees

Our immigration team is headed by Ansar Habib, who is a qualified Solicitors. He possesses more than two decades of experience in the field of immigration law. He is assisted by staff who are either trainee or experience case worker.

The fees outlined below are computed based on an average hourly rate of £220, excluding VAT. VAT at a rate of 20% will be added if applicable. The precise number of hours necessary for each case is contingent upon sever factors including the volume of supporting documents to review, language and weather the application involves other dependants.

Disbursements

The above fee table do no encompass disbursement, which represents expenses or fees associated with your case and are payable to third parties, such as Home office fees. You can pay these disbursements directly or we can manage these on your behalf provide you have deposited sufficient funds in our account.

Home office fees can vary depending on the type of application and visa duration. Appointment costs will fluctuate based on factors like location and method of application submission as well as whether you opt for a priority service.

In addition to the Home office fees, appointment costs, Immigration Health Surcharge fees and potential translation expenses, applicant may incur other charges such as Criminal Record Check, Evidence of English proficiency, TB test, Life in the UK test, DNA test etc. Please note this is not an exhaustive list and these costs are not applicable to all applicants.

Timescales

However, we normally take around 2 -6 weeks to submit your application from your instruction date, provided all documents are presented to us from outset. We will let you know at the earliest opportunity if it is likely to take longer than this. The time taken to prepare your application will depend on the complexity of your case and how quickly we receive the required supporting evidence from you.

The timescale taken to process an immigration appeal can vary, in-country appeals are ordinarily heard within 3 to 6 months, overseas immigration appeals are ordinarily heard between 12 to 18 months.

Disbursements

In addition to our fees, you will need to pay disbursements for conveyancing work. These are the costs paid to third parties and depends on type of transaction. Typical disbursements include:

Land Registry Fees

Fees are payable for:

– copy of the registered title and the plan
– other relevant copy deeds
– searches to check the buyer or borrower is not bankrupt.
– to protect buyers and mortgagees (lenders) from when the purchase is completed until the registration of the new owner or lender and for the application to register the new owner or lender.
– registration application fees – these vary according to the value of the property or amount borrowed and whether the property is already registered or if it is first registration application. We deal with applications through the Land Registry portal where possible to keep land registration fees to a minimum. Information about fees can be found on the Land Registry website.
– Leasehold Property Notice Fees
– If the property, you are buying is leasehold there are often notice fees payable to the landlord. For flats, there may be fees for information, dealing with Deeds of Covenant or transfer of shares payable to the landlord and/or Management Company. There may be a Certificate of Compliance fee. Such fees vary quite widely and cannot be confirmed until we have information from the deeds and/or the fee is confirmed by the person or Company to whom the fees are to be paid.

Searches

When buying or mortgaging property searches are required to gather more information about the property, for example, relating to road maintenance, planning and building regulations, drainage, mining and other environmental and flooding risks. Our standard search pack is £249 but it may vary depending on type of searches require for each transaction.

Insurance Policies

You will be advised if any policies are required on your matter which are to cover numerous risks where there is missing title information or documentation, there is an insolvency risk, to protect against chancel fee claims, or there is a breach of a covenant.

Bank Transfers

CHAPS/BACS payments charged at £42 per transfer are used to transfer funds on your purchase completion date to the seller’s Conveyancer and to redeem a mortgage.

Electronic Anti Money Laundering Checks

If required, the current cost is £8.50 per name.

Stamp Duty Land Tax

This is often payable on residential property purchases but will depend on various factors including:

· value of the property
· the amount of rent if a new lease
· if you are a first- time buyer
· whether you own or have owned either alone or with anyone else another property
· if you have inherited a property or are a beneficiary under a certain type of Trust which owns a property

Timescales

It’s challenging to provide an exact timeframe for when a transaction will be completed, as numerous factors influence the process. On average, a residential conveyancing transaction typically spans a duration of eight to twelve weeks. However, please be aware that specific circumstances can either expedite or delay this timeline.

Throughout your case, we will maintain open communication with you regarding completion dates and realistic timescales. We aim to keep you well-informed about the progress of your transaction and any potential obstacles or delays that may arise.

To determine the precise amount, you’ll need to pay in terms of Stamp Duty Land Tax, you can utilize HMRC’s website. If the property in question is in Wales, you can use the Welsh Revenue Authority’s website. It’s important to note that Stamp Duty Land Tax rates can change over time, so while we will provide our estimate based on the information you provide, we always cross-verify and confirm the exact amount of Stamp Duty Land Tax as of the date of your property purchase.

Selling a property

 Fees charged per hour:

We are more than happy to offer our services at an hourly rate, meaning you pay according to the time spent on your case. This pricing scheme also applies to any additional work we may have to carry out in additions to services arranged on a fixed fee basis. As stated above, we will notify you of any additional services billed on an hourly basis.

 DBA – Damages Based Agreement

Often referred to as ‘No-Win-No-Fee’ agreements, Damages Based Agreements (DBA) or Contingency Agreements or arrangements between clients and solicitors whereby the solicitor’s legal fees are only payable if the instruction is successful (as defined in the DBA).

These agreements can apply to a wide variety of situations, including contentious litigated legal proceedings and non-contentious instructions to recover assets or apprehend interests existing in corporate disputes, property interests or any other commercial arrangement or dispute.

In other words, a Damages Based Agreement is an arrangement in which the solicitor will share in the proceeds of a claim.  Accordingly, a DBA only applies in the following circumstances:

  • Money claims – it is not appropriate for any claims when an alternate remedy to damages is sought; and
  • Claimant’s legal costs – it is not appropriate for the legal costs incurred by a Defendant in proceedings, as there is nothing recoverable that can be shared with the solicitor (other than, as conventionally occurs, an award for the solicitor’s standard legal costs).

Legal costs incurred in non-contentious proceedings – for example negotiations to exit a company or any other circumstance where the client has a position which the solicitor can assist in resolving to the client’s financial benefit.
